Your acceptance of the Terms and Conditions is given when you make a purchase / order / booking from My Beautiful Scotland. It is important to read these Terms and Conditions carefully before buying goods / services from our website.


My Beautiful Scotland reserves the right to change these Terms and Conditions at any time and any such change will be effective once published on the website and will consequently apply to all purchase / orders / bookings.

We will endeavour to make sure that all information on our website is accurate and correct at all times and will try to resolve all information errors on the website as soon as reasonably possible. If you believe that such an error has affected you, please contact us by calling +44 (0)7493037469 or email us at enquiries@mybeautifulscotland.com, although we must stress, this does not admit liability on My Beautiful Scotland’s part.


GENERAL TERMS:


We are not responsible under these Terms and Conditions for any acts or events outside our reasonable control (force majeure), that adversely affect your purchase / order / booking, including (but not limited to) strikes, lockouts, failures of third party systems or networks, acts of god, fire, earthquake, storm, flood or other natural disaster, civil unrest, acts of terrorism, deliberate sabotage of or malicious damage to equipment or data or for damage to or destruction of premises or equipment.


Any notices relating to these Terms and Conditions will be sent to you via your registered e-mail address.

Our Terms and Conditions outline the entire agreement between My Beautiful Scotland and our customers regarding the sale, purchase and use of goods / services. They supersede any previous agreement or understanding that may have previously been in place. No variation to these terms is binding unless agreed by us in writing.


Save to the extent that you exercise your right as a consumer to bring an action in or rely on the laws of your country of domicile, the interpretation, construction, effect and enforceability of these Terms and Conditions shall be governed by Scottish Law, and you and we agree to submit to the non-exclusive jurisdiction of Scottish courts for the determination of disputes.


Import duties and taxes will be the responsibility of the customer should goods be ordered from our website for delivery outside the UK. These costs cannot be predicted and are outside our control. For International orders outside the UK, please be advised that shipping costs will be charged following your order.  

It is really important to ensure you have given us the correct billing address. If it is incorrect, we may not be able to process your order and you may incur additional costs to your credit/debit card.

We do our best to ensure that the information on the website is accurate and helpful at all times. However, we cannot ultimately guarantee the accuracy of all information nor be held liable for any decisions/actions you take based on the information provided, except where further agreement has been made, in writing by My Beautiful Scotland to you.


While we endeavour to keep the website running effectively, we cannot guarantee the availability nor accessibility of our online service at all times and except where outlined in these notices and disclaimers we will not be liable for any damages, loss, costs or expenses incurred by you as a result of any lack of availability or accessibility of the website.


Any link (whether it is a hyperlink or other referral device) used on the website is provided solely for the use and convenience of the visitor. The link does not represent any endorsement or recommendation by us and does not mean that we have any direct association with the linked website.

Nothing within these conditions operates so as to exclude, limit or restrict our liability for death or personal injury. Your statutory rights as a consumer are unaffected.


All Intellectual property rights and goodwill in or relating to the contents of our website belong to either ourselves or to our suppliers. 


You may not frame or link to the website or any part of it without our express permission.

WORKSHOPS & RETREATS:


1. Travel Insurance; When booking a workshop or retreat with My Beautiful Scotland, you must have comprehensive travel insurance covering cancellation (by you), any activities involved, and the destination. You are required to have travel insurance that covers any losses, expenses, and damages arising from trip cancellations, accidents, injury,  loss of personal items, and any flight / transportation cancellations or delays. 


 2. Deposit Requirement; A 20% deposit / or as stated, is required at the time of booking to secure your place. This deposit is non-refundable, as specified in each workshop / retreat description. 

As we plan for your experience, we invest in resources and preparations, as well as making advance payments required for third-party suppliers which often incur cancellation costs. 


3. Making a booking;  By booking a workshop / retreat through this website and paying the agreed deposit / fee, you agree to abide by these terms and conditions.  By accepting your booking, we agree to abide by these terms and conditions.

We reserve the right to refuse any booking without giving a reason.  


4. Final balance Payment; The remaining balance must be paid no later than three months before the scheduled start date of your workshop / retreat or as stated. Failure to pay the balance on time may result in your booking being treated as a cancellation.

 

5. Cancellations; In the event of a cancellation from your side, we will do all we can to provide a refund to you based on any refundable costs and backfills of the space.  Any cancellation by the client must be made in writing, emails are acceptable. The date on which the letter or email is received by us will determine how much of a refund is applicable.  Please note, all cancellations will be less any merchant fees paid by us and will incur a 10% administrative fee (deducted from any refund) for covering the resources involved in the back-filling process.


Refunds will be calculated as follows from the date in which you have notified us in writing; 

90 - 60 days before commencement - 50% refund

59 – 31 days before commencement - 25% refund

30 days or less before commencement - 0% - not eligible for a refund.


6. Workshop / Retreat Alterations and Cancellations:

My Beautiful Scotland, retains the right to cancel or alter any workshop or Retreat. Should adjustments or cancellations be required, we will inform you promptly, providing the choice to accept the changes or select an alternative workshop or Retreat. In cases where the alternative option is of a lower cost, the price difference will be refunded to you. Please be aware that My Beautiful Scotland is not liable for flight / travel expenses, as we are not involved in booking travel to / from the workshop location and do not receive payments for such arrangements. For additional details, please refer to Clause 1.


7. Itinerary; The nature of our workshops / Retreats requires flexibility, and itineraries are subject to change. Itinerary descriptions should be considered indicative rather than binding commitments.


8. Minimum Group Size; Workshops and Retreats require a specific number of participants to operate. This number varies by workshop / Retreat. In the event of a cancellation due to insufficient numbers, full payment, including the deposit, will be refunded. We aim to notify you of any cancellation at least six weeks before the workshop / Retreat date. Our liability is limited to amounts already paid.


9. Non-Transferable Bookings; Bookings cannot be transferred between participants or workshops.


10. Passport, Visa, and Health Requirements; All clients must hold a valid passport, along with any required visas, permits, and certificates (including medical certificates) for the entire journey. It is the client’s responsibility to obtain these.


11. Personal Responsibility and Health; Participants are responsible for their fitness and must inform us of any medical conditions / allergies at the point of booking. Compliance with the workshop leaders decisions is mandatory.


12. Injury and Illness Liability; My Beautiful Scotland is not liable for death, injury, or illness unless due to negligence of our workshop leaders during official duties.


13. Age Requirement; Participants must be 18 years or older.


14. Force Majeure; My Beautiful Scotland disclaims liability for cancellations caused by events classified as Force Majeure. These include unpredictable situations beyond our control, such as acts of war, civil disturbances, terrorism, natural catastrophes, fires, floods, or extreme weather conditions. In the event of a cancellation arising from Force Majeure, please refer to Clause 1 for further details.

 

15. Equipment; If any retreat leader offers their own equipment to you on loan on a workshop / retreat it is not covered by their insurance. By accepting the loan of the equipment, if it is damaged (however minor the damage) or stolen, you promise to pay immediately its full new replacement value direct to the retreat leader (s) so they can replace the item or items from a supplier of their choice who has the item or items in stock to ensure they can continue to pursue their business. If the item is no longer manufactured this clause applies to the latest new item from the manufacturer even if the value of this item is considerably higher.


16. Reporting Issues;  We actively welcome your feedback, both in respect of our own services and those provided by other suppliers (such as accommodation providers). In the event that you have any complaint during the course of your  workshop / retreat,  then please bring this to the attention of your  workshop / retreat leader as soon as possible, and we will endeavour to resolve the matter to your satisfaction. Any complaints regarding accommodation should, in the first instance, be raised with the relevant accommodation provider. Should this not be possible, you should make your complaint known to us in writing within 14 days of the completion of the workshop or retreat.


17. Privacy Policy; We only collect and retain customer information necessary to process orders, issue refunds, and provide essential information. We do not share personal details with third parties. Customers may request the deletion of their contact information by emailing   enquiries@mybeautifulscotland.com

 

18. Data Protection; We take your privacy seriously and will always endeavour to process your personal information in accordance with applicable data protection laws. In order to process your booking and to ensure that your travel arrangements run smoothly, we will need to use the personal information which you provide to us (such as your name, address, contact details, any special requirements etc). Where you have consented, we may also use the information provided to keep in touch with you and to advise you of the Company’s products and services (including special offers) from time to time. We may also pass personal information on to third parties (such as accommodation providers or other suppliers relevant to your booking) where necessary and where appropriate measures are in place. We will not, however, pass your information on to anyone who is not involved in providing (or arranging the provision of) any product or service related to your booking.

  

19. WhatsApp Groups; A WhatsApp group is created prior to the commencement of all workshops / retreats, this is to facilitate quick, clear and efficient communication related to the workshop / retreat and should only be used for specific related discussions, updates and announcements. All members are expected to communicate respectfully and professionally. There will be no sharing of sensitive company or customer information or forwarding any messages outside of the group. Please make us aware if you do not want to be added to the group prior to commencement of the workshop / retreat.


20. Acceptance of Terms; By completing the booking, you agree to these terms on behalf of all participants included in the booking.

 

My Beautiful Scotland is fully insured under The Package Travel and Linked Travel Arrangements Regulations 2018. In the event of their insolvency, protection is provided (excluding any flights, travel to/from the workshop location).
